NOTICE TO ALL UNIONIZED REGULAR FULL-TIME MEMBERS


The Toronto Transit Commission and the respective Unions, Local 113, CUPE Local 2, Lodge 235 and CUPE Local 5089, have ratified new contracts.

The Toronto Transit Commission and the respective Unions, Local 113, CUPE Local 2, Lodge 235 and CUPE Local 5089, have ratified new contracts and the following are the changes to the TTC Sick Benefit Association By-laws:

  • Effective May 16, 2014 all applications to the Association for payment of benefits shall be made within 30 calendar days of the date of absence.
  • Effective September 1, 2014, employees will not be paid SBA payments for the first full day of absence due to illness that a Member is otherwise eligible to receive payment for under SBA By-laws, for the fourth sick incident and each subsequent incident, in each calendar year.
  • The SBA Board of Director’s previously approved on a “trial basis” a revision to the 48 hour rule, By-law 4, Section 1(4)(a) – increasing it to 72 hours from the first day of absence. At the May 23, 2014 SBA Board meeting, the Director’s approved to remove the “trial period” and revise the by-law, on a go forward basis to now reflect that a Member has 3 days (72 hours) to seek medical attention. This by-law revision is effective May 23, 2014.

By-law 4, Section 1(4)(a) states in part:


To qualify for benefits from the first day of disability, a Member must be under the care of i.e. seen, clinically assessed and treated within three days (72 hours)following the first date of disability claimed by a licensed medical practitioner.”

Members are reminded that in order to be eligible for sick benefits, they are required to be treated by a licensed physician within three (3) days (72 hours), here are some examples.

  • Member sick on Monday, must be clinically assessed and treated no later than Thursday.
  • Member sick on Tuesday, must be clinically assessed and treated no later than Friday.
  • Member sick on Wednesday, must be clinically assessed and treated no later than Saturday.
  • Member sick on Thursday, must be clinically assessed and treated no later than Monday.
  • Member sick on Friday, must be clinically assessed and treated no later than Tuesday.
  • Member sick on Saturday, must be clinically assessed and treated no later than Tuesday.Member sick on Sunday, must be clinically assessed and treated no later than Wednesday.

Note: If the “no later than” date falls on a statutory holiday, a Member has until the next day to seek medical treatment.
